He does a fairly good job of explicating the problem, I just didn t find his argument entirely convincing The theorists he discussed were addressing the problem of legitimacy in government and they focussed on problems in ideal theory I can t help but see Waldron s own problem of legislation as a problem of non ideal theory The criticisms commonly levelled against legislatures is that the people in them tend to produce bad legislation, or at least that they are inconsistent in the quality of leg [...]

Waldron hides many of the flaws inherent in his argument in Law and Disagreement in this companion book He wants to use an idealized conception of legislation, divorced from the pathologies of legislation in actually existing legislatures, to argue against judicial review in theory but also in practice In other words, the warts of actually existing judicial review counts against it, but legislation is exempted from this standard This flaw only becomes apparent when you consider the arguments in [...]
